Governor Tom Wolf signed the budget the same day even though the spend number is less than his original $34.1 billion budget proposal, but an increase from last years’ budget (1.8% over what was spent and 4.4% more than what was passed). Due in part to better than expected revenues, the budget does not include any broad based tax increases or significant cuts to Human Services programs. The budget also saw just under $300 million deposited into the state’s Rainy Day Fund.

The final agreement does not include changes to the Alternative Energy Portfolio Standards to benefit the nuclear industry or the Commonwealth joining the Regional Greenhouse Gas Initiative (RGGI). RGGI received some traction in an attempt to use the carbon fees to fund the Governor’s plan on critical infrastructure, called Restore PA. The plan was originally tied to revenues from the Governor’s proposed tax on Marcellus Shale, which is even less popular that carbon fees. Fifty-five Democrats in the House and eight in the Senate voted against the spending plan due largely around environmental concerns, elimination of cash assistance for the needy and the budget plan not including an increase to the minimum wage. The Governor is looking to have the minimum wage increase considered in the fall session. Along with RGGI and AEPS changes, other energy and environment issues could come up in the fall. This includes Senators Camera Bartolotta (R-46) and Pat Stefano (R-32) alternative to Restore PA that would fund infrastructure projects throughout the state without the Governor’s severance tax. As part of his budget address, Governor Wolf proposed a bond issue – funded by an additional tax on the natural gas industry – to provide funding for blight remediation, storm water projects, flood prevention, brownfield cleanups and infrastructure projects. Bartolotta and Stefano proposed a plan that would fund similar projects through revenues generated by lifting the Governor’s moratorium on non-surface disturbance natural gas drilling on state forest lands. The Senators’ plan would not require the Department of Conservation and Natural Resources to authorize new non-surface disturbance horizontal drilling. It would only lift the moratorium on leases for existing well pads. “This legislation represents a commonsense approach to best protect and utilize our natural resources without massive borrowing that could have a negative impact on job creators and consumers,” Stefano said. “Imposing job-killing taxes and long-term debt will only result in a step backward for our state’s economy and environment.” “We have an opportunity to fund all of the projects that Governor Wolf wants to complete without creating new taxes that will stifle investment, chase away new jobs and boost energy costs to consumers,” Bartolotta said. “The natural gas industry already pays higher taxes in the form of impact fees that have helped fund billions of dollars in projects throughout the state. We need to explore different options other than piling on taxes that will ultimately be passed on to ratepayers.” As part of the alternative plan, revenues generated from new gas leases on state forest land would be placed in a special fund managed by the Commonwealth Financing Authority to be distributed for blight remediation, flood control infrastructure, storm water infrastructure, paving and repairing dirt and gravel roads, green infrastructure and abandoned mine reclamation projects. Lastly, House members are also pushing their “Energize PA,” plan they say will create jobs and redevelop infrastructure with no new fees or taxes. At a press conference the bill sponsors, Reps. Aaron Kaufer (R-Luzerne), Natalie Mihalek (R-Allegheny/Washington), Joshua Kail (R-Beaver/Washington), Jonathan Fritz (R-Susquehanna/Wayne), Tarah Toohil (R-Luzerne), Eric Nelson (R-Westmoreland), Mike Puskaric (R-Washington/Allegheny) and Tim O’Neal (R-Washington), along with House colleagues and individuals who support the initiative, including Local 66 Operating Engineers, talked about how the eight bills will create jobs, re-use abandoned manufacturing sites, and streamline permitting processes for brownfields and other sites. Kaufer’s bill, House Bill 1100, mirrors the existing Pennsylvania Resource Manufacturing Tax Credit that was established during the 2012-13 budget. This legislation would help large manufacturers using PA methane in production. House Bill 1101, sponsored by Mihalek, would increase the percentage rate cap for net loss deductions, otherwise known as net operating loss (NOL), that a business may carry forward. The current percentage is 40%, and her bill increases that to 45% in taxable year 2020 and 50% in taxable year 2021. House Bill 1102, introduced by Kail, would create the Keystone Energy Enhancement Act (KEEA). It is designed to encourage capital investment in Pennsylvania’s natural gas and manufacturing industries. House Bill 1103, championed by Fritz, would expand Pipeline Investment Program grants. Manufacturers will have a significant competitive advantage in production costs and Pennsylvania communities will be able to attract new manufacturing enterprises with readily available access to natural gas. Toohil’s House Bill 1104, would require the Department of Community and Economic Development to establish a registry for abandoned manufacturing sites throughout the state. By establishing this registry, a one-stop shop for available industrial properties, the state is making it clear that PA is open for business and wants that business. House Bill 1105, sponsored by Nelson, would further incentivize businesses to remediate properties that pose health and safety risks to our residents. Puskaric’s House Bill 1106 would reform the permitting process. Pennsylvania needs a regulatory and permitting structure conducive, not punitive, toward capital investment. Finally, House Bill 1107, sponsored by O’Neal, would create an independent commission to deal solely with the DEP permit process. This means the DEP can focus on enforcing environmental laws. Sets the application fee at $1 million. Licenses in the tourist development project cannot provide alcohol for off-premise consumption.
