Election Update Judicial, county, municipal and school board races were conducted on Tuesday, November 2nd. For the State Supreme Court, Republican Kevin Brobson won over Democrat Maria McLaughlin, but the majority stays 5-2. Another Republican, Megan Sullivan, won for Superior court against Democrat Timika Lane and two Republicans won races for the Commonwealth Court - Stacy Wallace and Drew Crompton over Democrat opponents Lori Dumas and David Spurgeon. Election day also saw two special elections for the State House. In the 164th House District to replace Margo Davidson, Democrat Gina Curry won the election. Next, Democrat Thomas Welby won election in the 113th State House District to replace Marty Flynn who was elected to the Senate earlier in the year.
Several state legislators ran and were successful in bids for other offices, including State Representative Tarah Toohil's (R-Luzerne) who won her race for judge in Luzerne County, Representative Ed Gainey (D- Allegheny) who won his bid for Mayor of Pittsburgh and State Senator John Sabatina's (D-Phila) who also won a judgeship. Delaware County saw Democrats win two spots for County Council (Kevin Madden and Rich Womack) as well as Sheriff, County Controller, and Register of Wills. Governor Tom Wolf Issues Executive Order on Minimum Wage/Paid Sick Leave On Friday October 22nd, Governor Tom Wolf announced that we would enact minimum wage and paid sick leave changes via an executive order. The Governor is directing the Department of Community and Economic Development to verify that businesses receiving state aid pay workers $13.50 as opposed to the current $7.50. The $13.50 minimum wage for state employees and contractors will reach $15 on July 1, 2024, under an executive order the governor signed in 2018. Governor Wolf is also asking DCED to verify that contractors provide paid sick leave to their employees. Highlights of the EC include:
On Friday, November 5th the US House passed the long awaited infrastructure bill previously approved by the US Senate. President Joe Biden stated he will quickly approve the $1.2 trillion Infrastructure Investment and Jobs Act package. The package contains $550 billion in new spending over five years for mass transit, roads, bridges, rail, expand electric vehicle charging stations, expand broadband, remove lead pipes and waterways. It is funded in part by the Corporate Profits Minimum Tax that would impose a 15% tax on corporations that report more than $1 billion in profits. The final vote was 228-206. Thirteen Republicans voted with the majority of Democrats in support of the bill, though six Democrats voted against it. Earlier in the week, President Biden issued comprehensive vaccine mandates for not only federal workers and contractors, but also employers with at least 100 staff. Further provides that the board may determine the amount of the bond required based on the total estimated cost to the commonwealth related to potential hazardous liabilities, decommissioning the permitted area, completing a reclamation plan for the affected site, the proper recycling or disposal of the alternative energy production project, and any other factor determined by the board. Provides an exclusion from the bonding requirements for a residence or business in the commonwealth that generates alternative energy for onsite consumption and for the owner or operator of a farm who owns and operates an alternative energy generation facility on the farm premises, regardless of location of consumption of the energy generated. Adds a second chapter requiring the Department of Environmental Protection to establish a solar forced labor prevention list and a rolling application process for admittance onto the solar force labor prevention list. Provides each commonwealth entity seeking to own, procure or otherwise participate in a solar project shall ensure that a selected panel manufacturer is included on the list. Also encourages a political subdivision or other local government entity to seek a solar panel manufacturer from the list when participating in a solar project. The new chapter relating to bonding shall take effect in 60 days and the remainder shall take effect immediately. Also allows the board to develop audit procedures to ensure supervision and scope of practice protections are maintained in a written agreement in accordance with the act. Provides that business firms that intend to apply for tax credits for contributions for students attending economically disadvantaged schools shall make those contributions to scholarship organizations which shall be separately accounted for and distributed by the designated scholarship organization. Establishes that tax credits for each fiscal year shall not exceed $200,000 annually per business firm and that a business firm may receive tax credits in any fiscal year for combinations of tax credits as specified. Provides that limitations for maximum tax credits shall not apply for applications accepted from December 1 through the end of the fiscal year if all tax credits authorized under the article for contributions to scholarship organizations, opportunity scholarships organizations, or pre-kindergarten scholarship organizations have not been awarded as of November 30 of any fiscal year. Establishes that the limitations set forth shall be reinstated for all applications accepted by the department after June 30 of the fiscal year notwithstanding a temporary increase in maximum tax credits available. Provides that the total aggregate amount of tax credits approved for contributions from business firms to opportunity scholarship organizations shall not exceed $50 million. Provides for increases in the amount of the scholarship for students attending an economically disadvantaged school dependent upon the grade the student is attending. Establishes opportunity scholarships of a maximum amount of $8,500 for a student without a disability and $15,000 for a student with a disability. Provides that reporting information related to opportunity scholarships and economically disadvantaged schools shall be based upon the 2019-2020 school year for start-up fiscal year 2019-2020.
